Terms of Service
Binding terms for passengers, drivers, and visitors: eligibility, bookings, conduct, liability, and governing law in South Africa.

1. Agreement
By creating an account, accessing, or using Hikingspot, you agree to these Terms. If you do not agree, do not use the service.
2. The service
Hikingspot provides tools to help coordinate inter-city travel between passengers and drivers, including trip matching, booking status, and related communications. Hikingspot is a technology platform; it does not itself provide transport as a carrier. Drivers and passengers are responsible for their own decisions and arrangements.
3. Eligibility and accounts
You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your account credentials and for activity under your account. You must be legally able to enter into a binding agreement in your jurisdiction.
4. Passengers
Passengers agree to provide truthful trip requests, respect confirmed bookings and trip status rules, and communicate honestly with drivers and support. Cancellation and no-show behavior may affect your ability to use the service, as described in-app.
5. Drivers and vehicles
Drivers represent that they hold valid licences and permissions required to operate their vehicle and provide rides in the areas where they drive, and that their vehicle is roadworthy and insured as required by applicable law. Drivers may be asked to complete verification steps (for example identity or vehicle documents). Failure to meet requirements or repeated safety issues may result in suspension or removal from the platform.
6. Bookings, trips, and payments
Trip details, fares, seat availability, and cancellation rules are governed by the in-app flows and any published fare or booking rules. Where payments are processed, they are handled by the payment methods and providers made available in the app. You agree to pay amounts you authorise and to resolve billing disputes through support channels where applicable.
7. Prohibited conduct
You may not misuse the service, harass others, submit false information, circumvent security, scrape or reverse-engineer the apps except as allowed by law, or use Hikingspot for unlawful activity. We may investigate and take action, including suspending or terminating accounts.
8. Intellectual property
Hikingspot names, logos, and the apps are protected by intellectual property laws. We grant you a limited, revocable licence to use the apps for personal, non-commercial use in line with these Terms.
9. Disclaimers
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
10. Limitation of liability
To the fullest extent permitted by law, Hikingspot and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the service is limited to the greater of amounts you paid to us for the service in the twelve months before the claim or the minimum amount allowed by law.
11. Indemnity
You agree to indemnify and hold harmless Hikingspot and its affiliates from claims, losses, and expenses (including reasonable legal fees) arising from your use of the service, your content, or your breach of these Terms, except where prohibited by law.
12. Suspension and termination
We may suspend or terminate access to protect users, comply with law, or enforce these Terms. You may stop using the service at any time. Account lifecycle options (such as deactivation or deletion with delayed anonymisation) are described in our Privacy Policy and in-app.
13. Changes
We may update these Terms. We will provide notice as required by law or through the app or website. Continued use after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of South Africa, unless mandatory consumer protections in your country require otherwise. Courts in South Africa have non-exclusive jurisdiction for disputes, where permitted.
15. Electronic communications and notices
You agree that we may send you service-related and legal notices electronically (including via the app or email). You are responsible for keeping your email and contact details accurate.
17. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, internet or power failures, or government actions.
18. Third-party services and links
The service may reference or interoperate with third-party maps, payment providers, app stores, or websites. Those third parties have their own terms and privacy practices. Hikingspot is not responsible for third-party services you choose to use outside our control.
19. Feedback, ratings, and suggestions
If you submit feedback, ratings, or suggestions, you grant us a non-exclusive, worldwide, royalty-free licence to use, copy, modify, and display them to operate and improve the service, without obligation to compensate you, except where law prohibits such a grant.
20. App marketplace rules
If you download our apps from Apple App Store or Google Play, you also agree to the applicable store rules. In case of conflict between store rules and these Terms regarding the Hikingspot service, these Terms govern your relationship with Hikingspot subject to mandatory store requirements.
21. Marketing communications
We may send optional marketing or product messages where permitted. You can opt out of marketing as described in-app or by contacting support. Service, security, and legal notices may still be sent where required.
22. Dispute resolution
We encourage you to contact support first to resolve concerns. If a dispute cannot be resolved informally, you and Hikingspot agree to bring claims in the courts of South Africa, unless mandatory consumer protection law in your country gives you the right to sue elsewhere.
23. Severability, assignment, entire agreement
If any provision is invalid, the remainder stays in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets. These Terms, together with policies linked from the Legal hub, are the entire agreement regarding the service.
24. Sanctions and restricted users
You may not use the service if you are prohibited under applicable trade sanctions or export laws, or if we are legally required to deny access.
